Law and Ethics Notes

Freedom of... Speech, Assembly, Religion, Press, Petition: First 5 Ammendment Rights.

These Freedom of Rights are not unlimited.



Public vs. Private Schools

Public schools have more freedom then private schools.



Tinker vs. Des Moines Independent Community School District (1969)

Tinker protest the war in a peaceful way. Were suspended for 5 days, sued them.

Surpreme Court says, "Shed their constitutional rights to freedom of expression or speech at the schoolhouse gate." In favor of Tinker.

Tinker standard: Unlawful Speech, Physically distruptive speech.



Bethel vs. Fraser (1986)

Inappropriate class president speech.

Passed the social appropriate standards, physical disruption. Going against what school is trying to teach.
